New federal regulations prohibiting information blocking — part of the omnibus 21st Century Cures Act passed by Congress in 2016 — took effect on April 5, 2021. “Information blocking” is defined as a practice that is likely to interfere with, prevent, or materially discourage access, exchange, or use of electronic health information. Any physician who maintains an EHR system is subject to the prohibition on information blocking. But without any guidance, it would be virtually impossible for physicians to know what actions (or inactions) constitute information blocking.
