OSHA Emergency Temporary Standard for the Health Care Industry

OSHA recently announced Emergency Temporary Standards for the Health Care Industry implementing ongoing safety precautions for health care facilities, including medical practices, to limit the spread of COVID-19.

Megan Heiden, Esq. with Smith Hulsey & Busey reviewed these new Emergency Standards and provided the information you need to comply with these new regulations that focus on the ongoing screening of patients and additional safety protocols.

NEW LAWS THAT MAY AFFECT YOUR MEDICAL PRACTICE

The Physicians Society of Central Florida hosted the first webinar in our series of virtual learning opportunities. PSCF Members can view the recording of New Laws That May Affect Your Medical Practice presented by Gregory A. Chaires, a Board Certified Health Law Attorney with the law firm of Chaires, Brooderson & Guerrero, P.L.

It was an active session again in health law and some new laws have just recently been signed by the Governor that may affect your practice. Those laws include revisions to the Non-Opioid Alternatives statute, Consent for Pelvic Exams, the Independent Practice for APRNs and under what circumstances that may happen, changes to the Consultant Pharmacists provisions, a broad bill by the Department of Health, and some changes to specific professions.

While Florida Law previously required physicians to discuss non-opioid alternatives with patients prior to administering or prescribing a Schedule II opioid and provide a copy of the state-approved educational pamphlet on non-opioid alternatives, a new law passed in 2020 (HB 743) that makes some slight changes to the law and REQUIRES a printed copy of the pamphlet to be provided. The new law, effective July 1, 2020, will no longer enable physicians to provide the pamphlet electronically.  In order to make compliance with the new law a little less onerous, we have partnered with Match-Up to provide Preferred Member Pricing for bundles of the pamphlet to be shipped to our members.   Please note, you can always just print a copy of the state mandated pamphlet, which you can find here , and hand it to your patients. You do not have to order copies of the pamphlet from the state or any other source.

EVOLVING HR CHALLENGES FOR PHYSICIANS DURING COVID-19

During this time, the DOL has continually revised its FAQs and regulations, providing additional guidance regarding the FFCRA. Some of these changes have significant implications to medical providers in particular. In addition, at this stage many employers, have or will shortly be seeking forgiveness of PPP loans under the CARES Act. Finally, employers are grappling with issues of returning employees to work and/ or seeking to make temporary work force reductions permanent.
